Terms of Service

Please read these terms carefully before using our services. By purchasing, you agree to these terms.

1 Acceptance of Terms

By accessing our website at apexdigital.com or purchasing any of our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

We reserve the right to update these terms at any time without prior notice. Continued use of our services after any changes constitutes your acceptance of the new terms.

2 Our Services

Apex Digital provides the following services:

  • Website design and development for businesses
  • Domain name registration and management
  • Web hosting and server management
  • Business email account setup
  • eCommerce website development
  • SEO setup and digital marketing support

The scope of each service is defined by the plan purchased. Services not listed in your plan are not included and will require a separate agreement.

3 Payment & Billing

All prices are listed in Indian Rupees (INR). GST at 18% is applicable on all purchases as per Indian tax law.

  • Payment is required in full before work begins on any project
  • We accept payments via net banking, UPI, credit/debit cards, and other online payment methods
  • Annual renewal fees are due on the anniversary of your purchase date
  • Failure to renew on time may result in service suspension
  • Renewal reminders will be sent 30 days and 7 days before the due date
⚠️ Prices are subject to change. Existing customers will be notified 30 days before any price revision.

4 Delivery Timeline

Standard delivery timelines are as follows:

  • 5-page business website: 7–10 working days
  • Classic/Premium plans: 14–21 working days
  • eCommerce websites: 21–30 working days

Timelines begin after we receive all required content (text, images, logo) from the client. Delays in providing content will extend the delivery timeline accordingly. Apex Digital is not liable for delays caused by the client.

5 Client Responsibilities

To ensure timely delivery, clients must:

  • Provide all required content, images, and materials within 7 days of purchase
  • Respond to design feedback and revision requests within 3 working days
  • Ensure all content provided does not infringe on any third-party rights
  • Provide accurate business information for the website
  • Keep login credentials confidential and secure

Clients are solely responsible for the legality of their website content. Apex Digital reserves the right to refuse service if content violates applicable laws or our acceptable use policy.

6 Intellectual Property

Upon full payment, the client owns all custom content created specifically for their website. However, the following remain the property of Apex Digital or their respective owners:

  • Proprietary tools, plugins, and templates used in development
  • Third-party stock images or assets licensed for use
  • Our internal code libraries and frameworks

Clients grant Apex Digital the right to display completed websites in our portfolio unless explicitly requested otherwise in writing.

7 Limitation of Liability

Apex Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of data, revenue, or business opportunities.

Our total liability to any client for any claim shall not exceed the amount paid by that client for the specific service in question.

We do not guarantee specific rankings in search engines, specific traffic volumes, or specific business outcomes from any website we create.

8 Termination

Apex Digital reserves the right to suspend or terminate services immediately if:

  • Payment obligations are not met
  • The client violates these Terms of Service
  • The website is used for illegal, fraudulent, or abusive activities
  • Content hosted violates applicable laws or third-party rights

Upon termination, access to all services will be revoked. Clients are responsible for backing up their own data.

9 Dispute Resolution

In the event of a dispute, we encourage clients to first contact our support team at support@apexdigital.top. We will make every effort to resolve issues amicably within 14 working days.

If a resolution cannot be reached, disputes shall be subject to binding arbitration under Indian arbitration laws before being escalated to a court of law.

10 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
